By using Bark & Bottle, you agree to these simple terms. If you don’t agree, please don’t use the site.

One quick note before the legalese: please sip responsibly. Your dog is a very good passenger — but a terrible designated driver. Never drive under the influence, and never bring a pup to a tasting without fresh water, shade, and plenty of patience. Cheers.

What Bark & Bottle is

Bark & Bottle is a free, curated directory of dog-friendly wineries. We describe places, link to their websites, and sometimes collect information submitted by wineries, readers, or partners. We do our best to keep listings accurate, but conditions change — please confirm dog policies, hours, and prices directly with each winery before you visit.

Who can use the site

Bark & Bottle is written entirely about wine, wineries, and alcohol. You must be at least 21 years old (the U.S. legal drinking age) to use the site. We don’t use a technical age gate, but by using Bark & Bottle you confirm you are 21 or older. If you are under 21, please don’t use the site.

Acceptable use

You agree not to:

  • Scrape or bulk-download the site
  • Attempt to disrupt or gain unauthorized access to the site
  • Impersonate a business or person when submitting information
  • Post content that’s illegal, harassing, or deceptive

User-submitted content

If you submit a winery or send us a message, you confirm that you have the right to share the content you’re submitting, and you grant Bark & Bottle a non-exclusive license to use it on the site. We may edit submissions for length, accuracy, and style, and we may decline to publish anything without explanation.

Intellectual property and copyright

Our original content, design, logos, and selection are ours. Third-party trademarks, logos, and photographs belong to their respective owners and are used for identification and editorial purposes.

If you believe material on Bark & Bottle infringes your copyright, send a notice under the Digital Millennium Copyright Act (17 U.S.C. § 512) to roger@northandvine.net with the subject line “DMCA Notice.” Please include: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) the URL or other specific location of the allegedly infringing material; (4) your contact information; (5) a statement that you have a good-faith belief that the use is not authorized; and (6) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner. We will respond to valid notices and may remove material as appropriate.

Third-party links

Our site links to winery websites, booking platforms, and other third-party destinations. We don’t control those sites and aren’t responsible for what’s on them.

No warranties

Bark & Bottle is provided strictly on an “as is” and “as available” basis, with all faults, and without any warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, title, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure, or that any listing, description, hour, price, photograph, map, or policy will be current, accurate, or complete. You use the site at your own risk. Always confirm details directly with a winery before you make plans.

Limitation of liability

To the fullest extent permitted by applicable law, Bark & Bottle, its operators, contributors, and affiliates will not be liable to you or anyone else for any loss, injury, damage, or claim of any kind — direct, indirect, incidental, special, consequential, exemplary, or punitive — arising out of or in any way connected with your use of the site, your reliance on any information on the site, your visit to any winery or third-party destination listed on the site, or the conduct of any winery, third party, or other user. This includes (without limitation) claims for lost profits, lost data, personal injury, property damage, emotional distress, loss of goodwill, or any other loss or harm, whether based in contract, tort, negligence, strict liability, statute, or any other theory, and whether or not we have been advised of the possibility of such damages.

Bark & Bottle is a free directory. If any limitation or exclusion in these terms is held unenforceable, our total aggregate liability to you, under any and all theories combined, will not exceed one U.S. dollar (US $1.00).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages; in those places, the exclusions and limitations above apply to the maximum extent permitted, and nothing in these terms limits liability that cannot be limited by law.

Governing law and venue

These terms and any dispute arising out of or relating to them or the site are governed by the laws of the State of California, without regard to its conflict-of-laws principles. The exclusive venue for any legal action is the state or federal courts located in California, and you consent to the jurisdiction of those courts.

Notice to California consumers

Under California Civil Code § 1789.3, California users are entitled to the following specific consumer-rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 N. Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Severability

If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid or unenforceable provision will be deemed modified only to the extent necessary to make it valid and enforceable.

Changes

We may update these terms from time to time. The “last updated” date at the top will reflect any change. Continuing to use the site after a change means you accept the updated terms.
